Environmental Protection Agency

To sustain the Payment Integrity at the EPA, the agency maintains a proactive process of conducting regular risk assessments of its programs and expecting regular, ongoing payment reviews. The recently released Executive Order 14249 mandates that federal agencies, including the EPA, conduct individual payment integrity reviews and reporting for each Federal Assistance Listing instead of grouping related programs. Previously, and for practical purposes, the EPA mostly had aligned its programs by payment processes. Recognizing the difficulty of this change, the EPA has created a robust implementation plan to move from its prior grants oversight model to this new, more detailed approach.

Starting this fiscal year, the Environmental Protection Agency's programs shifted to reporting improper payment information to the Office of the Controller on a monthly basis, rather than annually. Programs will continue to report on annual basis for the next couple of years as well for verification purposes. This outcome has been instrumental in reducing the time needed to resolve disputed payment costs.

In its annual compliance audit, released on May 27, 2025, the agency's Office of the Inspector General found the EPA was non-complaint with the requirements of the Payment Integrity Information Act. The agency disagrees with the non-compliance determination, however, the EPA concurred with the recommendations outlining an approach that would meet the OIG’s concerns and recent changes to government-wide Payment Integrity reporting.

Why recovery audits are not cost effective in certain programs

The PIIA requires agencies to conduct payment recapture audit reviews in any program expending more than $1 million annually. The low dollar value of improper payments recovered by an external payment recapture auditor led to the determination it was not cost-effective either for the agency or for the contractor. As a result, the EPA no longer uses a payment recapture audit firm to conduct formal payment recapture audits.
Nevertheless, the agency performs overpayment recovery activities internally, leveraging the work of agency employees and agency resources.

Supplemental Information

For more than seven years the agency has not had any Improper Payments identified. Less than once a year we get a "match" for a potential improper payment but each case the payment has been adjudicated as proper.

Actions recommended and planned to achieve compliance

On May 27, 2025, the EPA’s Office of Inspector General’s released its annual report of the agency’s prior fiscal year PIIA compliance. In the report, the EPA’s OIG stated that:??
The EPA did not comply with applicable Office of Management and Budget requirements for the Payment Integrity Information Act of 2019 for its fiscal year 2024 reporting. Specifically, for its grants payment stream, the EPA published a 0.77 percent improper payment estimate with no unknown payments."
The OIG also stated, "the agency’s estimate was not based on an accurate sampling and estimation methodology plan." [The OIG’s finding is based upon a staff member’s deviation from the agency’s statistical sampling methodology. The sample inadvertently left off a subset of grant programs that should have been included in the universe of potential sample selectees.]
As a result of its compliance review of FY 2024, the OIG made the following six recommendations to the EPA:
Develop and implement guidance to annually review, and update as needed, the Sampling and Estimation Methodology Plan (S&EMP). At a minimum, consider legislative, funding, structural, and any other changes impacting the EPA as part of its review to ensure that the S&EMP accurately reflects the grants program universe.
Develop and document internal processes to ensure that all applicable grant recipients and transactions are included in the sampling population universe and sampling frame so that the EPA produces a valid improper payment and unknown payment estimate.
Update the June 2019 S&EMP and internal standard operating procedures to reflect changes to internal processes to optimize efficiency and effectiveness of the S&EMP execution.
Perform statistical sample testing of the grants payment stream as part of the Payment Integrity Information Act of 2019 annual reporting for FY 2026 to effectively demonstrate payment integrity compliance. The statistical sample testing should utilize the updated S&EMP and updated internal standard operating procedures to ensure that the EPA has an accurate improper and unknown payment estimate for the grants payment stream.
Require staff to maintain documentation to support its sample selection, risk assessment reviews, and determinations of whether the EPA programs or payment streams are susceptible to improper payments, so that the EPA has evidence of compliance with its policies and procedures.
Develop and implement a process that requires staff to document and maintain documentation of any exceptions to payment integrity procedures to support the EPA’s adherence to its internal policies and procedures.
The agency disagreed with many of the findings but agreed to implement the recommendations.
For the finding of not reporting any unknown payments the agency will, in the restatement of estimated improper payments in the FY 2025 Annual Financial Statement, the EPA will clearly label the one row in the one table that previously used the term "Insufficient Documentation" only will now also include the term "Unknown Payment" as well. The other related standing tables in AFR already use both terms together.
For the finding that the agency was non-compliant with Criterion 6 Report on Payment Rates: Agencies need to report an improper and unknown payment rate of less than 10% for each program. (Applicable to federal agencies with an improper payment or unknown payment rate above 10%.).? Although, the agency believes that this criterion should be driven by an actual estimation of improper payment rate of 10% rather than speculation that the rate could have exceeded 10%, the EPA expects the rectified statistical sample will support an improper payment rate below 1.5% and well below 10%.
For the requirement the agency conduct a new statistical sample of the FY 2023 drawdowns. Instead of undertaking a full repeat of the sample, the agency opted to sample payments made from the specific grant programs that were inadvertently excluded from original sample. The agency took the additional of step of including only those grantees that only had grants from the missing grant categories as any of the other grantees could have been selected from the original sampling process. Specific drawdowns for each grantee were randomly selected. When the transaction testing was completed, the results when combined with the original sample resulted in an improper payment rate of 0.72%, slightly lower than original sample rate.
With the requirement that agencies switch to assessing program risk by assistance listings, the EPA is preparing to complete, a large number of qualitative risk assessments for most of its newly defined programs that exceed $10 million in annual outlays. A few programs, specifically the Clean Water State Revolving Fund and the Drinking Water State Revolving Fund will each continue with annual statistical sampling of its programs. These samples will use a well-established methodology that is distinct from the 2019 Grants Methodology OIG reference in its report. In addition, the Clean School bus program is currently working with agency statisticians to develop an updated Sampling and Estimation Methodology Plan. The new S&EMP is anticipated to be completed in late October/early November 2025 with implementation planned expected to begin one month later. This new S&EMP will serve as a model if other agency programs will need to complete a statistical sample of its payments.

Executive Order 14249 mandates that federal agencies, including the EPA, conduct individual payment integrity reviews and reporting for each Federal Assistance Listing instead of grouping related programs.
